Uniformly Funny — Terms of Service
Effective Date: September 22, 2026
These Terms of Service govern submissions to Uniformly Funny, operated and published by Black Creek Comics. By submitting a story or otherwise using the Uniformly Funny submission service, you agree to these Terms.
1. Your Submission
You represent that: you are at least 18 years old; the story is your original work or you have obtained all rights and permissions necessary to submit it; the story is unpublished unless Black Creek Comics has expressly permitted otherwise; the story is substantially true to the best of your recollection and is not knowingly fabricated or materially misrepresented; a firsthand submission is based on your own service in the United States military; for a secondhand submission, you are an authorized storyteller, family member, or other person with permission from the applicable service member or veteran; you have the legal right to grant the rights described in these Terms; you are responsible for the content you submit.
2. License You Grant to Black Creek Comics
You retain ownership of your story and its copyright. By submitting a story, however, you grant Black Creek Comics a non-exclusive, perpetual, worldwide, royalty-free license to use the submission for Uniformly Funny and related purposes, including the right to reproduce, edit, publish, distribute, display or publicly perform the story; adapt it as reasonably necessary for formatting or publication; create print and digital editions; include the story in books, anthologies, ebooks, audiobooks, websites, and related publications; promote and advertise Uniformly Funny, the applicable contest, and publications containing the story; use reasonable excerpts for promotional purposes; and translate or otherwise adapt the story as reasonably necessary for publication, promotion, or distribution. The license applies to the story’s use under the display name selected by the contributor. The license is non-exclusive — you remain free to use, publish, license, or otherwise exploit your story elsewhere, subject to any separate written agreement with Black Creek Comics. If a story is selected for publication in a printed book, the license expressly includes the right to publish, distribute, advertise, market, and sell that book. Except for an announced contest prize or a separate written agreement, publication does not create an obligation to pay royalties or additional compensation.
3. First Book Publication
For a story selected for publication in a book, Black Creek Comics will make reasonable efforts to contact the contributor before the story’s first publication in a book, to confirm display name, basic publication information, and other reasonable details. Failure to reach a contributor does not necessarily prevent publication where Black Creek Comics otherwise has the rights necessary to publish the story.
4. Editorial Control
Black Creek Comics may accept, reject, hold, fact-check, edit, shorten, or decline to publish any submission, and may make reasonable editorial changes for grammar, spelling, punctuation, clarity, length, formatting, privacy, legal compliance, factual clarification, or publication requirements. Black Creek Comics will endeavor to preserve the contributor’s original voice and meaning. Black Creek Comics may remove or change names and identifying information when reasonably necessary to protect privacy, comply with law, or reduce legal or safety concerns.
5. Withdrawal and Removal
You may request that an unpublished submission be withdrawn. A withdrawal request does not revoke rights already exercised or committed before Black Creek Comics receives the request (for example, material already printed, scheduled for distribution, or included in produced promotional material). Black Creek Comics may remove published content when it reasonably determines removal is appropriate because of legal, privacy, safety, factual, technical, editorial, or other legitimate concerns.
6. Safety, Privacy, and Other People
Do not submit: classified information; controlled or operationally sensitive military information; material you are not legally authorized to disclose; knowingly defamatory material; unlawful material; material that knowingly violates another person’s privacy or publicity rights; material that infringes another person’s copyright or other intellectual-property rights; or personal information belonging to another person that you do not have permission or a lawful basis to disclose. Entrants should use aliases or generalized descriptions for other people when appropriate. You are responsible for obtaining any permission necessary to submit or publish material concerning other people. Black Creek Comics does not independently verify every factual statement in every submission.
7. Artificial Intelligence
AI tools may be used for limited assistance such as spelling, grammar, proofreading, or editing. You may not knowingly submit a substantially AI-generated story as your own original work or falsely represent the authorship of a submission. Black Creek Comics may reject a submission if it reasonably determines the entrant misrepresented its authorship or origin.
8. No Guarantee
Submitting a story does not guarantee acceptance, publication, publication in a particular book or by a particular date, selection as a finalist or contest winner, payment of a prize, or continued availability of the submission service. The service may be changed, suspended, or discontinued.
9. Contest Rules
When a submission is made in connection with a specific Uniformly Funny contest, the applicable Official Contest Rules also apply. If these Terms conflict with the Official Contest Rules concerning a particular contest, the Official Contest Rules control with respect to that contest.
10. Contributor Representations and Warranties
By submitting, you represent and warrant: legal capacity to enter these Terms; ownership or control of the rights necessary to submit the story; no knowing infringement of another person’s copyright or intellectual-property rights; necessary permission obtained for a secondhand story; no knowingly submitted classified or operationally sensitive information; no knowingly submitted unlawful or privacy-invasive material; no knowing fabrication or material misrepresentation; and information provided to Black Creek Comics is accurate to the best of your knowledge.
11. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, costs, and reasonable expenses arising from your material breach of these Terms, including claims resulting from your knowing submission of material you did not have the right or permission to submit. This does not require you to indemnify Black Creek Comics for losses caused by Black Creek Comics’ own conduct to the extent such indemnification is prohibited by applicable law.
12. Limitation of Liability
Black Creek Comics does not guarantee the submission service will always be available, uninterrupted, secure, or error-free. To the extent permitted by applicable law, Black Creek Comics will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the submission service or from a submission. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
13. Privacy
Personal information submitted through Uniformly Funny will be handled according to the Uniformly Funny Privacy Policy.
14. Publicity
If you are a contest winner or published contributor, Black Creek Comics may use your selected display name and information you have authorized for contest, publication, and promotional purposes, subject to applicable law. Additional consent will be obtained when required by law.
15. Copyright Complaints
If you believe material published through Uniformly Funny infringes your copyright or other rights, you may contact Black Creek Comics using the official legal/contact information provided on the website.
16. Changes to These Terms
Black Creek Comics may update these Terms from time to time. The version in effect at the time of a submission will generally govern that submission, except where a later change is required by law or applies prospectively to continued use. The effective date will be displayed at the beginning of the Terms.
17. Governing Law and Disputes
The governing law, venue, arbitration provisions, and official legal/contact address will be completed and reviewed by counsel before public launch. Nothing in these Terms limits rights or remedies that cannot legally be waived.
18. Military Affiliation Disclaimer
Uniformly Funny and Black Creek Comics are independently operated. Black Creek Comics is not affiliated with, endorsed by, sponsored by, or operated by the United States government or any branch of the United States Armed Forces. Stories published through Uniformly Funny represent the experiences or recollections of their contributors.
19. General Provisions
If any provision of these Terms is unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision does not waive the right to enforce it later. These Terms, together with the applicable Official Contest Rules and Privacy Policy, constitute the applicable agreement concerning use of the Uniformly Funny submission service.
